3. AI-Powered Services — Special Terms

Our services extensively use artificial intelligence. By engaging our AI-powered services, you agree to the following additional terms:

3.1 AI Phone Answering

Our AI phone system will answer calls to your business phone number during configured hours.
The AI will identify itself as an AI assistant at the beginning of each call.
Calls may be recorded and transcribed for quality assurance, training, and service improvement.
You are responsible for ensuring AI phone answering complies with all applicable laws in your jurisdiction, including state and federal call recording consent laws.
In two-party consent states, the AI will notify callers that the call is being recorded.
You authorize Kynex Pro to answer calls and interact with your customers as your agent.

3.2 AI Text Messaging and SMS

Our AI systems may send text messages to your customers on your behalf for appointment reminders, follow-ups, review requests, and marketing purposes.
You represent that you have obtained proper consent from recipients to receive text messages, as required by the Telephone Consumer Protection Act (TCPA) and applicable state laws.
All AI-generated text messages will include opt-out instructions (reply STOP to unsubscribe).
You are responsible for maintaining accurate opt-out lists and honoring unsubscribe requests.
Standard message and data rates apply to recipients. Kynex Pro is not responsible for carrier charges.
Text messages may be identified as sent via an automated system where required by law.

3.3 AI Chatbots

AI chatbots deployed on your website will interact with your visitors and collect information such as names, phone numbers, email addresses, and service requests.
You are responsible for disclosing the use of AI chatbots on your website in your own privacy policy.
Chatbot conversations are stored and may be used to improve AI performance.

3.4 AI Content Generation

Content generated by AI (blog posts, social media posts, marketing copy) is reviewed by our team before publication, but may contain inaccuracies.
You are responsible for reviewing and approving all AI-generated content before it is published on your platforms.
Kynex Pro is not liable for errors, omissions, or claims arising from AI-generated content that you approve and publish.

3.5 AI Automation Workflows

Automated workflows (email sequences, social media scheduling, review request campaigns) operate on schedules and triggers you configure or approve.
You are responsible for reviewing automation settings and ensuring they comply with applicable laws, including CAN-SPAM, TCPA, and platform terms of service.
Kynex Pro will not send marketing communications to individuals who have opted out.

4. Your Responsibilities

When using our services, you agree to:

Provide accurate and complete business information
Maintain proper consent from your customers for AI-powered communications
Review and approve AI-generated content before publication
Comply with all applicable local, state, and federal laws
Notify us promptly of any customer complaints related to AI interactions
Maintain up-to-date opt-out and do-not-contact lists
Not use our services for any unlawful or fraudulent purpose

5. Website Use

5.1 Free SEO Audit Tool

Our free SEO audit tool is provided for informational purposes only. Results are generated using third-party data sources and AI analysis. We do not guarantee the accuracy, completeness, or timeliness of audit results. Audit results do not constitute professional advice.

5.2 Blog and Educational Content

Blog posts, guides, books, and other educational content on our website are provided for informational purposes only. Some content is generated with the assistance of AI. Content does not constitute professional, legal, financial, or marketing advice.

5.3 Prohibited Uses

You agree not to:

Scrape, crawl, or automatically extract content from our website for commercial purposes
Attempt to gain unauthorized access to our systems
Use our website to distribute malware, spam, or other harmful content
Misrepresent your identity or affiliation when using our services

6. Intellectual Property

Our property: The Kynex Pro website, brand, logo, software, and proprietary AI systems are owned by Kynex Pro LLC. You may not copy, modify, or distribute our intellectual property without written permission.
Your property: You retain ownership of your business name, logos, photos, and original content you provide to us.
Work product: Websites, content, and marketing materials we create for you under a paid service agreement become your property upon full payment, except for proprietary AI systems and software which remain our property.

7. Payment Terms

Service fees are outlined in your individual service agreement or proposal.
Payment is due according to the schedule specified in your agreement.
Late payments may result in suspension of services after 15 days past due.
We reserve the right to modify pricing with 30 days written notice.

8. Limitation of Liability

To the maximum extent permitted by law:

Kynex Pro is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
We are not liable for any loss of business, revenue, or profits resulting from AI system errors, downtime, or inaccuracies.
We are not liable for actions taken by our AI systems that were within the scope of their configured purpose, even if the outcome was undesirable.

9. Indemnification

You agree to indemnify and hold harmless Kynex Pro, its officers, directors, employees, and agents from any claims, damages, or expenses (including attorney fees) arising from:

Your use of our services in violation of these Terms
Your failure to obtain proper consent for AI-powered communications
Your approval and publication of AI-generated content
Your violation of any applicable law or regulation

10. Termination

Either party may terminate services with 30 days written notice.
We may suspend or terminate services immediately if you violate these Terms.
Upon termination, we will provide you with your data and website files within 30 days of request.
AI phone answering and automation services will cease upon termination.

11. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in Mecklenburg County, North Carolina, in accordance with the rules of the American Arbitration Association. Both parties waive the right to a jury trial.

12. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.

13. Changes to Terms

We may update these Terms from time to time. We will notify active clients of material changes via email. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
